2. Products and Bespoke Orders

Customization: We specialize in personalized items. You are responsible for ensuring all text, images, and instructions provided for Custom Requests are accurate.
Approvals: Once you have approved a digital proof via email or WhatsApp, no further changes can be made, and no refunds will be issued for errors present in the approved proof.
Variations: Due to the nature of sublimation and custom printing, actual product colours and layouts may vary slightly from the electronic mock-ups.

3. Pricing and Payment

All prices are displayed in South African Rand (ZAR).
Full payment is required before production begins for custom orders.
We reserve the right to change pricing at any time without prior notice.

4. Delivery and Shipping

We offer Nationwide Delivery via third-party couriers like Pudo.
Delivery times are estimates and not guaranteed. Handyfox is not liable for delays caused by courier services.
Risk of loss passes to you upon delivery of the goods to the address provided.

5. Returns and Refunds

In accordance with the Consumer Protection Act:
Standard Items: You have a 7-day "cooling-off" period to return unused, non-customized items in their original packaging for a refund.

Customized Items: As per Section 20 of the CPA, items made to your specific specifications are exempt from the right of return unless they are defective.
Defects: If a product is defective, please notify us within 48 hours of receipt with photographic evidence.

6. Privacy and Data Protection (POPIA)

We are committed to protecting your personal information as required by the Protection of Personal Information Act (POPIA).
We collect only the information necessary to process your order and for Direct Marketing if you have opted-in.
You may request the deletion or update of your data at any time by contacting us.

7. Intellectual Property

All content on this website, including logos, designs, and product photos, is the property of Handyfox Creative Products and is protected by South African copyright laws.

8. Limitation of Liability

Handyfox Creative Products shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa.

10. The Fox Den (Exclusive Club) Membership

Participation: Membership in The Den is voluntary and subject to these Terms. By joining, you agree to receive exclusive offers, early access to new products, and promotional news via your provided contact details.
Loyalty Rewards: Any loyalty credits or vouchers issued are as good as cash but cannot be exchanged for physical currency. Rewards are subject to availability and may have expiration dates as clearly stated at the time of issue.
Account Security: You are responsible for maintaining the confidentiality of your membership details. Handyfox is not liable for unauthorized use of your rewards.

Data Usage (POPIA): By joining, you provide explicit consent for Handyfox to process your personal data (name, email, and purchase history) to tailor exclusive offers to your preferences. You may opt-out at any time.
Modification & Termination: Handyfox reserves the right to modify or terminate the club or its benefits at any time. In accordance with the CPA, we will provide at least 20 business days' notice of any significant changes to reward values or availability.

11. Intellectual Property Rights & Right of Refusal

Third-Party Intellectual Property: Handyfox Creative Products strictly adheres to South African and International copyright and trademark laws. We will not produce any items that feature logos, characters, brand names, artwork, or photographic imagery belonging to other entities or persons without explicit written permission from the rights holder.
Customer Warranty: When submitting a custom design or request, you (the Customer) warrant that you own the rights to the content or have obtained all necessary licenses to reproduce it.

Indemnity: You agree to indemnify and hold Handyfox Creative Products harmless against any legal claims, damages, or expenses (including legal fees) arising from a breach of third-party intellectual property rights resulting from your specific request.
Right of Refusal: We reserve the absolute right to refuse service for any order that we, in our sole discretion, believe may infringe on the intellectual property of others or contains content that is offensive, defamatory, or unlawful. If an order is refused on these grounds, any payment made will be refunded minus any administrative or design time already incurred.
